Curated News BriefBased on original reporting by HousingWire (October 7, 2026). The summary below is the Journal’s; the local analysis is original commentary by Omar Murillo.

According to HousingWire, the Department of Housing and Urban Development has opened an investigation into Wells Fargo's mortgage lending programs that were designed to increase homeownership among Black borrowers. HUD's Fair Housing and Equal Opportunity office is examining the bank's Special Purpose Credit Program and related racial equity homeownership initiatives that Wells Fargo launched in 2017 and expanded in 2022. The agency believes these programs may violate the Fair Housing Act, with HUD's assistant secretary arguing that creating race-based lending practices cannot be justified simply by calling them equity initiatives.

Wells Fargo made significant public commitments in this area over the years. Back in 2017, the bank pledged to lend a substantial amount to qualified African American borrowers for home purchases within a ten-year window. By 2022, following reports that the bank had approved fewer than half of Black applicants for refinancing, Wells Fargo announced additional funding to support racial equity in homeownership and to help borrowers access better mortgage rates and refinancing options.

HUD's investigation centers on whether Wells Fargo has been making lending decisions based on race, which the Fair Housing Act prohibits. The agency cited the bank's diversity reports and public statements about closing homeownership gaps between racial groups as evidence for concern. Even though Wells Fargo removed explicit diversity language from its website in 2025 and quietly rebranded its approach as inclusion and accessibility, HUD says the bank's long track record of race-conscious lending programs raises questions about whether the practice continues.

HUD's Office of Special Investigations will determine whether Wells Fargo violated or intends to violate fair housing laws. The agency has instructed the bank to preserve all records related to its mortgage lending policies, including emails and messages from personal accounts. Depending on what investigators find, HUD could file an administrative complaint or pass the case along to the Department of Justice for enforcement action.

Wells Fargo has significantly scaled back its mortgage business in recent years, announcing a strategic retreat from the broader market in early 2023. Despite this pullback, the bank remains a substantial player in servicing mortgages and continues to originate a considerable volume of loans annually, according to industry data cited by HousingWire.

What I am seeing locally here in the Bay Area and throughout the East Bay is that conversations around lending practices and fair housing are becoming increasingly scrutinized at the federal level. For our buyers and sellers, this kind of regulatory action serves as a reminder that lenders operate under strict guidelines, and questions about how those guidelines are applied deserve serious attention. Whether you're working with Wells Fargo or any other institution, understanding their lending practices and how they treat all applicants fairly should be part of your due diligence when securing financing.
